Resident Rights- an Overview

Resident's Rights are guaranteed by the federal 1987 Nursing Home Reform Law. This law requires nursing homes to "promote and protect the rights of each resident" and emphasizes individual dignity and self-determination. If a facility participates in Medicare or Medicaid they are required to meet these federal requirements.

Some of the rights protected include:

The right to be fully informed of:

  • Available services and charges
  • Advance plans for a change of room or roommate
  • Facility rules and regulations
  • Address and telephone number of the State Ombudsman and state survey agency

The right to complain or file a complaint with the state.

The right to particpate in your own care including:

  • Recieving adequate and appropriate care
  • Being infomred of all changes in your medical condition
  • Participating in your own assessment, treatment and care planning
  • Refusing medication, treatment and restraints

The right to privacy and confidentiality.

The right to dignity respect and freedom.

The right to visits by physicians, relatives and friends.

If you are concerned that a facility is not guaranteeing the rights of residents, contact your local or state long-term care ombudsman.
